1. Acceptance of these Terms

EmeraldPoint provides educational information and learning materials focused on home entrance organization and exterior design topics. This includes beginner guides, articles, checklists, and workshop-related information about mailbox styles, house identification, parcel receiving ideas, exterior organization, and minimalist design principles.

To the maximum extent permitted by law, EmeraldPoint will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including loss of profits, loss of data, business interruption, or reputational harm, arising out of or relating to your use of or inability to use the Service.

To the maximum extent permitted by law, EmeraldPoint’s total direct liability for any claim arising out of or relating to the Service will be limited to the lesser of: (a) the amount you paid to EmeraldPoint for the Service in the twelve months before the event giving rise to the claim, or (b) 100 EUR.

Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including for death or personal injury caused by negligence, or for fraud.

8. Indemnification

You agree to indemnify, defend, and hold harmless EmeraldPoint and its officers, directors, employees, and contractors from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Service, (b) your violation of these Terms, or (c) your violation of any law or the rights of a third party.

The Service may reference third-party websites or resources for background reading or context. We do not control and are not responsible for the content, policies, or practices of third-party sites. Accessing third-party sites is at your own risk.

10. Privacy

11. Governing law and jurisdiction

12. Dispute resolution

Before filing a formal claim, you agree to contact us and attempt to resolve the dispute informally for at least 30 days. If we cannot resolve the matter informally, either party may bring a claim in the courts specified in the Governing law and jurisdiction section.
